VOIP Networks and Cloud9 Infrastructure (“VOIP Networks”, “we”, “us”, “our”) offer a platform for cloud unified communications as a service (“UCaaS”) system, enabling organizations to communicate across multiple locations, with mobile workers and with clients, no matter where they are and no matter what device they prefer.

This Privacy Notice explains our privacy practices and describes how we handle the personal information of website visitors and current and prospective customers that we collect through our interaction with you when you visit our websites, when you use our desktop, IP desk phone, mobile applications (“apps”), cloud communications and collaboration solutions, and our related services. This Privacy Notice also describes choices that may be available to you regarding use, access, deletion and correction of your personal information.

Additional information on our personal information practices may be provided in supplemental terms and conditions, supplemental privacy statements, or notices provided prior to or at the time of data collection.

This Privacy Notice does not apply to personal information about our customers’ end users or authorized users that we process on behalf of our customers. We process this information as instructed by our customers, in our capacity as a service provider/data processor, in accordance with the terms of our customer agreements.

Information We Collect

VOIP Networks collects information in order to provide its products and services and to manage its business.  The types of information VOIP Networks collects may include:

Information you provide to us

We collect your personal information when you actively provide it to us through your interactions with us, including the following categories of information:

  • Contact details, including your first and last name, username, phone number, and email address (your email address may be used for account registration and for marketing emails).
  • Identifiers, including IP address, identity documents, and any other identifiers a user provides when accessing or using our services or visits our websites.
  • Payment information, including billing name, address, and credit card or other payment information.
  • Company information, such as your company’s name and location.
  • Communications that we exchange with you, including when you contact us with questions, feedback, or otherwise.
  • Marketing information, such as your preferences for receiving communications about our services and publications, and details about how you engage with our communications.
  • We may also collect information through your interactions with our website, apps and services as a user or participant, including user content, such as files, the content of communications, including call recording, SMS (including the content of blocked SMS messages that violate our spam rules), voicemails, or other information you or another user or participant provide.

Information we obtain from other sources

‍We may obtain your personal information from other third parties, such as channel partners, marketing partners, data providers, another user of our apps and services, and publicly available sources.

Data collected automatically

We and our service providers may automatically log information about you, your computer or mobile device, and your interaction over time with our services, such as:

  • Device data, such as your computer’s or mobile device’s operating system, manufacturer and model, browser type, IP address, unique identifiers, language settings, mobile device carrier, and general location information such as city, state or geographic area; and
  • Usage data, such as pages or screens you viewed, how long you spent on a page, browsing history, and access times.
  • Call detail records produced by a telephone call, text message, or other telecommunications transactions. The call detail records contain various attributes of a call, such as time, duration, completion status, source number and destination number.
  • A user hosting a conferencing meeting may choose to record the session, and if so, the host is responsible for obtaining any required consent from you.
  • call center reporting, and
  • fax to email information.

We may collect this information using cookies and other similar technologies. Cookies are text files that websites store on a visitor‘s device or in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitating online advertising. How We Use Personal Information

We use personal information for the following purposes:

To provide our services

  • Complying with applicable law including laws and regulations governing call detail records.
  • Administering, hosting, and operating our services;
  • Sponsoring events, contests, and promotions;
  • Communicating with you and responding to any inquiries you may have;
  • Personalizing your experience with the app and our communications and making recommendations to you based on your choices and interests; and
  • Analyzing your use of our services to allow us to evaluate and improve the services.

For research, development, benchmarking, and improving our services

We may use personal information to analyze and improve the services, identify trends, and operate and expand our business activities. We may also create aggregated, anonymized, or other de-identified statistics, which we may use for lawful business purposes, including for analytics, forecasting, and strategic planning. We may use this anonymous data and share it with third parties for our lawful business purposes, including to analyze and improve our services and promote our business.

For marketing and advertising

Direct marketing. We may send you direct marketing communications, including, but not limited to, sending newsletters or publications, and notifying you of promotions, offers and events via postal mail, email, telephone, and other means. You can manage your communication preferences by following the instructions included in any promotional email from us to unsubscribe from that mailing.

Interest-based advertising. We may engage third-party advertising companies to display our ads on their online services. We may also share information about our users with these companies to facilitate advertising for our services to them or similar users on other online platforms. For compliance and protection, including to enforce any applicable terms and conditions, comply with legal obligations, defend against legal claims or disputes, protect the security and integrity of our services, and identify and investigate fraudulent, harmful, unauthorized, unethical or illegal activity.

Mobile information, including text messaging originator opt-in data and consent, will not be shared with third parties/affiliates for marketing/promotional purposes.

To Whom We Disclose Personal Information

We may disclose personal information solely for legitimate business or legal purposes as described in this Notice and in accordance with applicable law, with the following third parties:

‍Affiliates. our corporate parent, subsidiaries, and affiliates, for purposes consistent with this Privacy Notice.

Service providers companies and individuals that provide services on our behalf or help us operate our services or our business (such as hosting services, communications, data and cyber security services, billing and payment processing services, fraud detection, investigation and prevention services, web and mobile analytics, email and communication distribution and monitoring services, and customer relation management systems).

Professional advisors. professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.

‍Business partners. business and channel partners, resellers, and distributors for these partners to market or sell our services.

‍Advertising partners. third-party advertising companies, including for the interest-based advertising purposes described above.

‍Authorities and others. to law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate.

Business transferees. to acquirers and other relevant participants in business transactions (or negotiations for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, VOIP Networks or our affiliates (including, in connection with a bankruptcy or similar proceedings).

We take your privacy seriously. We retain personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Notice, including to provide our services, comply with legal obligations, and resolve disputes.

Unsubscribe from direct marketing communications: You may opt out of marketing-related communications by following the opt-out or unsubscribe instructions contained in the marketing communication we send you. You may continue to receive service-related and other non-marketing communications.

These choices do not apply to service notifications or other required communications that are considered part of certain apps and services, which you may receive periodically unless you stop using or cancel the app or service in accordance with its terms and conditions.

In case of deletion, will delete the personal information we hold about you, unless an exception applies. For example, we may retain certain information as required by law or for legitimate business purposes such as resolving disputes and enforcing our agreements.

Data Security

We employ a number of technical, organizational and physical safeguards designed to protect the personal information we collect. However, no security measures are failsafe, and we cannot guarantee the security of your personal information. Our services are not intended for use by children under 18 years of age. If we learn that we have collected personal information through our services from a child under 18 without the consent of the child’s parent or guardian as required by law, we will delete it.
